If you submit a demo request, contact form, or other inquiry, you represent that the information you provide is accurate and that you have the authority to submit it on behalf of any organization referenced. We may use the information to respond to your inquiry as described in our Privacy Policy.

6. Customer agreements

If you purchase or use the RMM Catalyst platform, your use of the platform is governed by a separate customer agreement (e.g., Master Subscription Agreement and applicable Order Form) executed between you and RMM Catalyst. Those agreements control to the extent of any conflict with these Terms.

7. Third-party links

The Site may contain links to third-party websites. We do not control and are not responsible for the content, privacy practices, or policies of those websites.

8. Disclaimers

The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, RMM Catalyst disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of content. We do not warrant that the Site will be uninterrupted or error-free.

9. Limitation of liability

To the fullest extent permitted by law, RMM Catalyst, its affiliates, and their officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Site, even if advised of the possibility of such damages. Our aggregate liability arising out of or relating to your use of the Site will not exceed one hundred US dollars (US $100).

You agree to defend, indemnify, and hold harmless RMM Catalyst from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or your misuse of the Site.

11. Governing law and venue

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict-of-laws principles. The exclusive venue for disputes arising out of or relating to these Terms or the Site will be the state or federal courts located in Virginia, and you consent to their personal jurisdiction.

12. Changes

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
